Welcome to FreeOnlineHost.com! Here your dreams and ambitions, your obsessions and occupations can be displayed and shared with the world. FreeOnlineHost.com provides every member with FREE space to host a web site of their own. All we ask in return is that you follow a few simple rules. So before you create your first page here at FreeOnlineHost.com, please be sure you have read, and understood, these Terms and Conditions. Members who do not follow rules and regulations could find their entire web site removed and/or deleted, most often without prior notice. The interpretation of these guidelines is at the sole discretion of FreeOnlineHost.com:

1. FreeOnlineHost.com is capable of giving away free web space thanks to the sponsorship of our advertisers. In return, each page that you create will have an advertising banner automatically inserted into it (one banner per page at the top of the viewable browser window). You may not remove, resize so as to render invisible or unreadable, or otherwise block any of the banners that FreeOnlineHost.com inserts onto your web pages; 
2. You must provide a valid email address from an ISP, not a free email address such as Yahoo, Hotmail or Gmail. You must also provide a correct address, contact name, and phone number that we can reach you at.
3. Your site must be in the following languages for free web hosting: English, French. We apologize for the inconvenience, but at the moment most of our advertisers support only those Language-based websites.
4. FreeOnlineHost.com is not responsible for the content of any personal home page, nor do the opinions or ideas expressed in user-generated web pages necessarily reflect those of FreeOnlineHost.com. The contents of user-generated web pages are not reviewed or censored in any way before they appear on FreeOnlineHost.com;
5. You may not set up a "gateway" site on the FreeOnlineHost.com server. A "gateway" site is one which serves only as an entrance to the actual site located on a non-FreeOnlineHost.com server;
6. Your page should be in English, French or any of the languages specified as a choice when you sign up;
7. Your page should be active - that is, it is either receiving 'hits' or is being updated/posted to. Sites that either receive no hits or are not updated over a period of 30 days will be considered 'inactive' and may be removed by FreeOnlineHost.com to make room for other users;
8. You may not use your web space to provide material, or links to material, that is grossly offensive to the Web community. This includes:
   • Blatant expressions of bigotry, racism, hatred, or profanity;
   • Promotion or display of instructional information supporting illegal activities; this includes, but is not limited to, instructions for the building or use of weapons, propagation of "spam" email and/or computer viruses, or any material that infringes the intellectual property rights of third parties;
   • Promotion of physical harm or injury against any group or individual;
9. You may not password protect any link provided on any of your pages located on the FreeOnlineHost.com server;
10. Your Web Pages may not contain, nor contain links to, any of the following:
    • Adult and Child pornography, obscene material, bestiality and pictures that you don't have the right to publish.
    • Hate propaganda;
    • Anything illegal including, but not limited to, illegal software, warez or hacked software, serial numbers, mail fraud, or pyramid schemes;
    • Material insulting, or that could be considered defamatory or libelous, to other persons, institutions or companies;
    • Material that exploits children;
    • Material which attempts to collect personal information about users;
    • Materials infringing the intellectual property rights of third parties (including, but not limited to, trademarks, domain names, personality rights, names of individuals, publicity rights, logos, graphics, designs, films, and music), those which allow the circumvention of revenue rightfully due to a manufacturer for the sale of a product or the disabling of installed copy protected devices, and all other forms of cracker utilities, are strictly forbidden;
11. You may not use your web space for 'data warehousing' ; that is, using our space as storage for large files which are only linked from other sites;
    • The following list of file types are the only file types permitted on FreeOnlineHost.com members sites. All other file types are not permitted:
      

      js, swf, au, snd, mid, midi, ram, wav, gif, jpg, wrl, vrml, css, html, htm, rtf, png, psd, ico, doc, php, sql, cgi;

      Any other files located by FreeOnlineHost.com will be automatically deleted.

    • The maximum upload file size is 5MB. The limit for jpegs is 1 MB, for gifs is 1MB and for HTML or Text files is 0.5MB.
    • Your site has to have its content consisting of mostly text, sites having mostly Photo Albums and graphics will not be accepted and deleted if found to break this rule. 
12. You may not use unsolicited email to promote your site;
13. FreeOnlineHost.com reserves the right to block or delete any site due to inappropriate behavior by the webmaster towards FreeOnlineHost.com, its staff or its users, which has been validated on public or private forums;
14. You may not copy or reproduce any page, image or other content without the express prior consent of the original copyright owner of that content;
15. By joining FreeOnlineHost.com you automatically receive our FreeOnlineHost.com E-News newsletter and occasional special promotions. You can unsubscribe from the newsletter by following the given instructions within the newsletter.
16. Free hosting: By submitting a web page to FreeOnlineHost.com or any other web page hosting service on The FreeOnlineHost.com Network, you grant FreeOnlineHost.com a royalty-free, nonexclusive, worldwide, unrestricted license to use, copy, transmit, publicly display, publicly perform, create compilations including, and distribute such web page, and any associated Content, for the limited purposes of publishing and promoting the user's web page in connection with the particular service with which the user has chosen to have the web page hosted, and for publishing and promoting such web page elsewhere within the FreeOnlineHost.com Network. Such license shall apply with respect to any form, media, or technology now known or later developed. This term will extend only for the duration of the user's membership with the particular FreeOnlineHost.com service. In the event that such membership is terminated, FreeOnlineHost.com will relinquish all rights to the user's Content following the duration of any applicable promotional activities ongoing at the time the membership is terminated.
17. If you are 13 years of age or under you may not become a member of FreeOnlineHost.com! The protection of children's online privacy is very important to The FreeOnlineHost.com Network. For that reason, it is our policy not to collect or maintain information at our web sites from those we actually know are under 13 and no part of our web sites is structured to attract anyone under 13.

MEMBERS WHO ARE FOUND IN BREACH OF THESE RULES ARE SUBJECT TO HAVING THEIR MEMBERSHIP CANCELLED WITHOUT NOTICE AND FURTHER ACCESS DENIED. FreeOnlineHost.com. FURTHER RESERVES THE RIGHT TO TAKE LEGAL ACTION AGAINST ANY MEMBER IN BREACH OF THESE RULES AND TO PROVIDE INFORMATION TO LAW ENFORCEMENT AUTHORITIES AND OTHER INTERESTED PARTIES REGARDING THESE MEMBERS.

LEGAL TERMS

You, as the author of your pages, take full responsibility for its contents. As the author you state your page contains nothing illegal, obscene, pornographic, degrading or abusive to another person, including pages that promote hate group propaganda and child pornography. As the author, you also state that nothing on your page is copyrighted material and that any links to other servers have been approved by that organization. As the author, you also state that nothing on your page infringes on the intellectual property rights of any third party. You agree that FreeOnlineHost.com has the right to remove any page it determines, in its sole discretion, has violated these rules to cancel your membership and take against you whatever measures will be deemed appropriate including legal action and disclosing information about you to law enforcement authorities and other interested third parties. Members who are in breach of these rules agree to indemnify and hold harmless FreeOnlineHost.com.com for any loss, claim, damage and expenses (including reasonable attorneys' fees) arising from or in connection with the contents of any personal home pages or of any chat or messages on a bulletin board found to be infringing or illegal. By submitting your pages, you agree to all the above terms.

FreeOnlineHost.com makes no guarantee as to availability of service. To the fullest extent permissible by law, FreeOnlineHost.com excludes all liability with respect to accuracy, content or availability of information on its web site. The materials in this site are provided "as is" and without warranties of any kind, either express or implied. FreeOnlineHost.com does not warrant that the function contained in the materials available on this web site will be uninterrupted or error free, that defects will be corrected, or that this site or the servers that make them available are free of viruses or other harmful components. Any merchandise products or services available to users or members from links from this web site are provided by third parties who are not necessarily affiliated or connected with FreeOnlineHost.com. To the fullest extent permissible by law, FreeOnlineHost.com.com excludes all liability under any circumstances (including negligence) for any special or consequential damages that result from the use of, or the inability to use, the materials on this site. Applicable laws may not apply to all those who access the web site.

-The free package is advertisement-supported, meaning that we place advertisements on your page in order for us to continue our services. You will not receive CGI access for security and CPU usage reasons. If you feel that you need CGI access, please contact support@freeonlinehost.com.

- Please do not signup with a free email address such as Hotmail or Gmail. All email addresses are verified and must be from your ISP.

-No IRC allowed! Anyone caught using mIRC related scripts will automatically be terminated, and any other form of misuse of this server will be reported to the proper authorities for prosecution.

-Anyone using more than 5% of system resources at any time may be automatically terminated or suspended by the account administrator. No "resource hogging" scripts will be allowed!

-No adult content, spamming, or otherwise harmful/destructive activity.

- In consideration for hosting services to be delivered, Subscriber agrees to be bound to the following terms:

- Subscriber agrees to be bound by the service term selected on the online order form or via applicable promotional codes.
Subscriber agrees that no adult content or adult dating sites or illegal content of any kind will be placed on any website in the network.
 
- Subscriber agrees to adhere to the FreeOnlineHost.com Acceptable Use Policy.

- Subscriber agrees not to engage in activity that violates federal, state or local laws applicable to the service terms described herein.

- FreeOnlineHost.com reserves the right to discontinue service to any subscriber it deems, in its sole discretion, violates any condition of service including the Acceptable Use Policy and Terms of Services.

- Subscriber agrees to indemnify and hold harmless FreeOnlineHost.com and the employees and agents of FreeOnlineHost.com against any losses, claims, damages, liabilities, penalties, actions, proceedings or judgments (collectively, "Losses") to which an Indemnified Party may become subject and which Losses arise out of, or relate to this Agreement or Subscriber's use of the Services and Products, and will reimburse an Indemnified Party for all legal and other expenses, including reasonable attorneys' fees incurred by such Indemnified Party in connection with investigating, defending or settling any Loss whether or not in connection with pending or threatened litigation in which such Indemnified Party is a party.

- FreeOnlineHost.com SHALL NOT BE LIABLE FOR (i) ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS OR LOSS OF REVENUE RESULTING FROM THE USE OF FreeOnlineHost.com'S SERVICES AND PRODUCTS BY SUBSCRIBER OR ANY THIRD PARTIES, OR (ii) ANY LOSS OF DATA RESULTING FROM DELAYS, NONDELIVERIES, MISDELIVERIES OR SERVICE INTERRUPTIONS WE PROVIDE THE SERVICES AND PRODUCTS AS IS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED FreeOnlineHost.com DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE SUBSCRIBER SHALL BE SOLELY RESPONSIBLE FOR THE SELECTION, USE AND SUITABILITY OF THE SERVICES AND PRODUCTS AND FreeOnlineHost.com SHALL HAVE NO LIABILITY THEREFORE.

- Arbitration. ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS CONTACT OR ANY BREACH THEREOF IN EXCESS OF $250.00 SHALL BE SETTLED BY ARBITRATION IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES OF THE BRITISH ARBITRATION AUTHORITIES AND JUDGMENT UPON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

- Notices. Unless otherwise specified herein, any notices or other communications required or permitted hereunder shall be sufficiently given if in writing and delivered personally or sent by facsimile transmission, internationally recognized overnight courier, registered or certified mail, to the address or facsimile number of Subscriber as set forth in the Service Descriptions or as set forth below. Such notices or other communications shall be deemed received (i) on the date delivered, if delivered personally, (ii) on the date that return confirmation is received, if sent by facsimile, (iii) on the business day (or, if international, on the second business day) after being sent by an internationally recognized overnight air courier or (iv) five days after being sent, if sent by first class registered mail, return receipt requested.

- Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the country where FreeOnlineHost resides, without regard to choice of law provisions that would cause the application of the law of another jurisdiction.

We reserve the right to deny any IP address from signing up for our service.

We reserve the right to stop our free web hosting service at any time, for any reason.

By becoming a Member, you agree to all the above terms.
